Investigation Reports

In Crown Office directed investigations the Commissioner produces a report for the Crown Office to allow the Lord Advocate to determine what further action is appropriate. The Police Public Order and Criminal Justice (Scotland) Act 2006 does not authorise the Commissioner to publish a report on a Crown Office directed investigation.

Where the Commissioner conducts an investigation following a referral from Police Scotland or other policing bodies operating in Scotland, the findings are normally published. In cases where there may be on-going criminal investigations into related matters the Commissioner may be unable to publish the findings until after the conclusion of the criminal investigation and any subsequent court proceedings. The legislation enables the Commissioner to publish findings on these investigations at an appropriate point.

In the case of a referral from the Scottish Police Authority (SPA) regarding Senior Office Misconduct, the Commissioner must submit the written report of the investigation to the SPA. It is the responsibility of the SPA to determine what, if any, action to take. In this instance the Commissioner will not publish the report of the investigative findings.
