In Crown Office directed investigations the Commissioner is not authorised, in terms of Section 43 (8) of the Police, Public Order and Criminal Justice (Scotland) Act 2006 as amended by the Police & Fire Reform (Scotland) Act 2012, to publish her report.
Where the Commissioner conducts an investigation following a referral from the Chief Constable or from another policing body operating in Scotland, the legislation permits the Commissioner to publish her conclusions unless criminal proceedings are still in contemplation.
Where the Commissioner conducts an investigation following a referral from the Scottish Police Authority (SPA) regarding misconduct by a senior officer of the rank of ACC and above, the Commissioner is not authorised to publish her report.

Commissioner updates his Statutory Guidance
In April 2013 the Commissioner updated his statutory guidance. Some of changes were necessary in light of amendments made to the definition of a complaint about the police within the Police and Fire Reform (Scotland) 2012 ("the 2012 Act").
